DUI Arrests in Santa Monica: Case Studies
In defending yourself in a DUI case in Santa Monica, it helps to know you are not the first individual to face charges of drunk driving. A Santa Monica DUI case study provides an example of what can happen if you are arrested for driving under the influence in California.
On July 24, 2007, Santa Monica police found actress Lindsay Lohan by a parking lot having a heated debate with her former assistant who had been recently fired. After failing several field sobriety tests, Lohan was taken to a police station where her blood alcohol level was found to be above the legal limit.
Lohan was arrested on a felony charge of possession of cocaine and misdemeanor charges of driving under the influence and driving with a suspended license. Lohan spent 84 minutes in jail for her second DUI and in August 2007 she entered Cirque Lodge Treatment Center in Sundance, Utah despite having a previous DUI conviction.
Mounting a criminal defense was not the only legal hurdle Lohan faced. She was also sued by three men who were passengers in her vehicle when she was stopped and arrested for her second DUI. The lawsuit was filed in a Santa Monica, California Superior Court by Ronnie Blake, Jason Sutter, and Dante Nigro. The trio sought unspecified damages, claiming that Lohan was angry and aggressive in her driving, causing them to feel "shock, fear, and panic." Lohan's attorney called the lawsuit "absurd."
This DUI case study illustrates the severe consequences of a DUI arrest and the need for an experienced DUI attorney especially if this is your second or subsequent arrest for driving under the influence. The DUI laws in Santa Monica make few allowances and having an attorney by your side throughout the legal process can help you cope with the complexity of mounting a criminal defense.
